Frequently Asked Questions
Can my landlord increase the rent when my Dubai tenancy is renewed?
Yes, provided the increase complies with the applicable Dubai rental framework. Where a change to the rent or other tenancy terms is proposed, at least 90 days' notice before expiry is generally required unless the parties have agreed otherwise. The permitted rent increase should also be checked against the applicable DLD rental index.
Can a landlord evict a tenant because the property is being sold?
Yes, but the sale does not automatically end the tenancy. Where eviction is sought for sale after expiry of the tenancy period, the statutory requirements must be followed, including notice at least 12 months before the intended date of eviction, served through a Notary Public or by registered mail.
What documents should I give a rental dispute lawyer in Dubai?
Provide the tenancy contract, Ejari certificate, addenda, payment records, cheques, notices, emails, messages, inspection reports and photographs. Complete documentation is important because dates, informal agreements and inconsistencies can affect the dispute.
Can a Rental Disputes Center decision be appealed?
Some RDC judgments are appealable. First-instance judgments in claims below AED 100,000 are generally final, subject to statutory exceptions, including certain eviction judgments. Where an appeal is available, the current appeal period is generally 15 days, so the judgment should be reviewed promptly to determine whether an appeal is available and when it must be filed.
Can an RDC judgment for eviction or unpaid rent be enforced?
Yes. Once a judgment is enforceable, execution proceedings may be used to pursue monetary awards, eviction orders and other relief granted by the Rental Disputes Center.
