Litigation Lawyers in Dubai for Civil and Commercial Disputes

AY Advocates represents businesses, financial institutions, shareholders, contractors, developers and private clients in civil and commercial disputes across the UAE. Our litigation lawyers in Dubai work with licensed Emirati advocates on contractual claims, payment disputes, shareholder matters, urgent applications, appeals and enforcement proceedings.

As a litigation law firm, we assess more than whether a claim can be brought. The available evidence, counterparty, recoverability, jurisdiction and commercial objective can all affect whether litigation is the right course and how proceedings should be approached. Where an early settlement or negotiated resolution can achieve the required outcome, that option is considered before unnecessary proceedings are commenced.

Where court action is required, our litigation and dispute resolution lawyers manage the matter from evidence gathering and pleadings through hearings, appeals and enforcement. UAE litigation is highly procedural and document-driven, making complete records, properly prepared submissions and careful management of procedural deadlines important throughout the case. Our Emirati advocates represent clients before local and federal courts across the UAE, including the Courts of First Instance, Appeal and Cassation where the relevant right of appeal is available.

We also advise on disputes that may fall within the jurisdiction of the DIFC Courts or ADGM Courts. Both operate English-language common-law court systems with their own procedural rules. Jurisdiction, governing law and dispute resolution clauses should therefore be reviewed carefully before proceedings are started.

What We Do

  • Commercial disputes: Contractual breakdowns, supply and distribution failures, agency terminations, and disputes between shareholders or joint-venture partners. We assess both the strength of your position and the recoverability of the counterparty early, so that you are not funding a claim against an empty shell.
  • Civil claims and damages: Claims in tort and under the Civil Code, including negligence, wrongful interference with business, and compensation for material and moral damage. Quantum before the UAE courts is largely expert-led, so we build the evidential record for the expert stage from the first day rather than the last.
  • Debt recovery and enforcement: Payment orders, cheque claims, and execution against bank accounts, salaries and property. We also act at the pre-action stage, where a properly drafted legal notice frequently recovers the debt without proceedings at all.
  • Precautionary attachment and travel bans: Urgent applications to freeze accounts, attach assets and restrain a debtor from leaving the country. Timing decides value here: an attachment obtained before a counterparty restructures is worth considerably more than a judgment obtained after.
  • Enforcement of judgments and awards: Recognition and execution of foreign judgments and arbitral awards before the execution courts, and enforcement of DIFC and ADGM judgments onshore.
  • Appeals and cassation: Appeals to the Court of Appeal and the Court of Cassation, including matters we did not run at first instance. Cassation is confined to points of law, so the grounds must be identified precisely, and we will tell you candidly when there are none.
  • Alternative dispute resolution: Mediation, negotiated settlement and expert determination. A settlement reached in month three is usually worth more than a judgment in year two, and we treat that as a legitimate outcome rather than a failure of nerve.

Who We Act For

AY Advocates acts for UAE and international corporates, banks and financial institutions, family offices, contractors and developers, shareholders and private individuals.

Our commercial dispute resolution lawyers advise on contractual, payment and business disputes. Where a matter concerns shareholders, directors, joint ventures or company ownership, a corporate litigation lawyer can assess the dispute together with the relevant corporate and contractual documents.

Frequently Asked Questions

How long does a case take in the UAE courts?

There is no fixed timeframe. The duration depends on the nature and complexity of the claim, service requirements, evidence, expert appointments, procedural applications and whether the judgment is appealed.

Do I need to appear in court myself?

Not in every matter. Our Emirati advocates can represent clients before the relevant UAE courts, although personal attendance may be required in particular proceedings or if directed by the court.

What documents will you need from me?

Relevant documents may include the contract and amendments, correspondence, invoices, payment records, notices and evidence of the alleged breach or loss. It is usually better to provide the complete record so that missing evidence can also be identified early.

Can I recover my legal costs?

The court may award costs, but a successful party should not assume that all legal fees will be reimbursed. Court fees, expert expenses and other recoverable amounts depend on the proceedings and the orders ultimately made.

Can a corporate litigation lawyer assist with shareholder disputes?

Yes. A corporate litigation lawyer may advise on disputes involving shareholders, directors, joint ventures, ownership rights, contractual obligations and corporate governance, depending on the facts and applicable jurisdiction.
